Realtor Ethics and Legal Duties

In Ontario, the Trust in Real Estate Services Act (TRESA) governs the conduct of real estate professionals. This legislation ensures that agents maintain high standards of honesty, integrity, and transparency. If you enter a representation agreement, you become a client. Your agent must provide you with undivided loyalty, meaning they put your interests above their own and those of any other party. TRESA recently changed how agents interact with individuals who choose not to hire a professional. These individuals are Self-Represented Parties (SRPs). If you are an SRP, an agent representing the other side cannot provide you with advice, opinions, or services. They must remain loyal to their client. This distinction ensures that clients receive expert guidance while self-represented individuals understand they are responsible for their own legal and financial protections.

Realtors also follow a strict Code of Ethics enforced by the Real Estate Council of Ontario (RECO). This code requires agents to provide conscientious and competent service. If an agent lacks expertise in a specific area—such as a complex rural property in Caledon or a commercial lease in Orangeville—they must inform you and suggest you seek specialized assistance.
